By downloading, installing, or using the FreshGo application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

FreshGo is a platform that:

Allows customers to discover nearby food vendors in real-time and receive alerts when their preferred food types are available nearby.
Allows vendors to broadcast their location to potential customers and manage their online presence.

3. User Accounts

3.1 Registration

To use FreshGo, you must create an account by providing accurate and complete information, including a valid phone number. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Types

Customer Account: Allows you to browse vendors, set food preferences, and receive notifications.
Vendor Account: Allows you to register your food business, broadcast your location, and reach customers. Vendor accounts require an active subscription to access certain features.

3.3 Account Termination

You may delete your account at any time through the App. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Vendor Terms

4.1 Vendor Approval

All vendor accounts are subject to approval. We reserve the right to approve, reject, or revoke vendor status at our discretion.

4.2 Subscriptions

Vendor features require an active subscription. Subscription payments are processed through Stripe. By subscribing, you agree to:

Pay the applicable subscription fees
Stripe's terms of service for payment processing
Automatic renewal unless cancelled before the renewal date

4.3 Vendor Responsibilities

Vendors agree to:

Provide accurate business information
Maintain food safety standards as required by local regulations
Only broadcast their location when actively operating
Not misrepresent their food offerings or availability

5. User Conduct

You agree not to:

Use the App for any unlawful purpose
Impersonate any person or entity
Interfere with or disrupt the App or servers
Attempt to gain unauthorized access to any part of the App
Use automated systems to access the App without permission
Harass, abuse, or harm other users or vendors

6. Location Services

FreshGo requires access to your device's location to function properly:

Customers: Location is used to show nearby vendors and trigger proximity alerts.
Vendors: Location is shared with customers while you are broadcasting.

You can disable location services at any time, but this will limit the App's functionality.

7. Notifications

By enabling notifications, you consent to receive push notifications about:

Nearby vendors matching your food preferences
Account and subscription updates
Service announcements

You can disable notifications in your device settings or within the App.

8. Intellectual Property

All content, features, and functionality of the App—including but not limited to text, graphics, logos, and software—are owned by FreshGo and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

The App will be uninterrupted or error-free
Vendor information is accurate or up-to-date
Food quality or safety from any vendor

FreshGo is a discovery platform only. We are not responsible for the quality, safety, or legality of food sold by vendors.

10. Limitation of Liability

To the maximum extent permitted by law, FreshGo and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

Your use or inability to use the App
Any transactions between customers and vendors
Unauthorized access to your account or data
Any food-related illness or injury

11. Indemnification

You agree to indemnify and hold harmless FreshGo and its owner from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Third-Party Services

The App integrates with third-party services including:

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted within the App or on our website. Continued use of the App after changes constitutes acceptance of the modified Terms.
